By accessing or using Digmenu (the “Service”), operated by Digmenu (“we,” “us,” or “our”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to all of these Terms, do not use the Service.
We may update these Terms at any time. We will notify you of material changes via email or through the Service. Your continued use after such changes means you accept the updated Terms.
Digmenu is a digital menu platform that enables businesses to create, host, and share online menus and QR codes.
We offer two plans:
We may modify, add, or remove features, change limits, or adjust prices at any time with reasonable notice. Changes apply to future billing periods for existing subscribers.
You must be at least 13 years old (or the minimum age required in your jurisdiction) and have the legal capacity to enter into a binding contract. By using the Service, you confirm that you meet these requirements.
If you are using the Service on behalf of a business or other legal entity, you represent that you have authority to bind that entity to these Terms.

You are responsible for all activity that occurs under your account.
Payments for the Pro Plan are processed by our third-party payment processor, which acts as the Merchant of Record. By purchasing a Pro subscription, you agree to the payment processor’s terms as well.
Pro subscriptions are billed in advance on a recurring basis (monthly or annually, as selected) and renew automatically until cancelled.
You may cancel your Pro subscription at any time through your account settings or by contacting us. Cancellation takes effect at the end of the current billing period; you retain Pro access until then.
We may change Pro Plan prices with reasonable prior notice. New prices apply to renewals after the notice period.
Except where required by applicable law (including Kosovo consumer law), all fees are non-refundable. Any refunds we choose to provide are at our sole discretion and will follow our Refund Policy, if any.
All rights, title, and interest in and to the Service (including software, code, design, branding, logos, and content, except your menu content) are owned by Digmenu or our licensors and are protected by copyright and other intellectual property laws.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business purposes during your subscription term (or while using the Free Plan).
You retain all rights to your menu content (text, images, prices, etc.). You grant Digmenu a worldwide, non-exclusive, royalty-free license to host, display, and transmit your content solely to provide the Service.
You are responsible for ensuring that your content does not infringe any third-party rights and complies with applicable laws.

We may suspend or terminate your access to the Service if we reasonably believe you have violated these Terms or engaged in harmful or illegal conduct.
You may stop using the Service at any time. For Pro subscriptions, cancellation follows Section 5.3.

Upon termination, your right to use the Service ends immediately. We may, but are not obligated to, provide you a reasonable opportunity to export your menu content.
To the maximum extent permitted by applicable law, the Service is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, or completely secure.

Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited under applicable law.
You agree to indemnify, defend, and hold harmless Digmenu and its officers, directors, employees, and agents from any claims, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of:
Our collection and use of personal data is described in our Privacy Policy, which forms part of these Terms. By using the Service, you acknowledge that we may process personal data in accordance with the Privacy Policy and applicable data protection laws, including Kosovo’s Law on Protection of Personal Data.
These Terms are governed by and construed in accordance with the laws of the Republic of Kosovo, without regard to its conflict of law principles.
Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the Republic of Kosovo, unless mandatory consumer protection laws provide otherwise.
If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision shall be enforced to the maximum extent possible or, if that is not possible, shall be deemed removed, and the remaining provisions shall remain in full force and effect.
Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision. Any waiver must be in writing and signed by Digmenu.
These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Digmenu regarding the Service and supersede any prior or contemporaneous agreements or understandings.
